Welcome to ViaPure Wellness, LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website viapurewellness.com (the “Site”) and any services we provide, including nutritional consultations, Nutrition Response Testing®, wellness assessments, supplement recommendations, Heart Sound Recorder evaluations, PEMF therapy, Norma Tec recovery sessions, physical therapy rehabilitation techniques, and related offerings (“Services”).

1. Acceptance of Terms

By accessing or using the Site or booking any Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or our Services. We may update these Terms at any time. Your continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.

2. No Medical Advice or Treatment

Our Services are holistic and wellness-oriented. They are not medical services, do not diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider. Nothing we provide should be considered medical advice. Always consult your physician or qualified healthcare professional before beginning any new wellness program, nutritional changes, supplement regimen, or therapy, especially if you have existing health conditions, are pregnant, or take medications. You assume full responsibility for any decisions you make based on our Services or recommendations.

3. Eligibility

You must be at least 18 years of age (or have parental/guardian consent if under 18) to use the Site or receive Services. By using the Site, you represent that you meet these requirements.

4. Appointments and Scheduling

Appointments are scheduled through the Site, phone, email, or our booking system. You agree to provide accurate and complete information when booking. We reserve the right to refuse or cancel any appointment at our discretion.

• Cancellations: Please cancel or reschedule at least 24 hours in advance. Late cancellations or no-shows may incur a fee of $75 (or the full session fee, whichever is applicable). Fees must be paid before future bookings.
• Lateness: Arriving more than 15 minutes late may result in a shortened session or rescheduling.

5. Payments

Fees for Services are provided at the time of booking or upon inquiry. All payments are processed securely. All sales are final. We do not offer refunds for completed Services unless required by law. Packages or prepaid services may have specific terms provided at purchase.

6. User Conduct

You agree not to:

• Use the Site or Services for any illegal, fraudulent, or unauthorized purpose;
• Submit false, misleading, or inaccurate information;
• Harass, threaten, or abuse our staff or other users;
• Attempt to interfere with the operation or security of the Site.

7. Intellectual Property

All content on the Site (text, graphics, logos, images, materials) is owned by ViaPure Wellness, LLC or our licensors and is protected by copyright and other laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimers and Limitation of Liability

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY RESULTS FROM OUR SERVICES WILL BE ACHIEVED.

TO THE FULLEST EXTENT PERMITTED BY LAW, VIAPURE WELLNESS, LLC, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ViaPure Wellness, LLC, its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any law or third-party rights.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida.
